Solar Federal Investment Tax Credit (ITC)
The most significant solar incentive is the Solar Investment Tax Credit offered by the federal government. The ITC allows solar owners to claim 26% of the total cost of their solar energy system, including labor and equipment, as a tax credit against their tax liabilities. The best part is, if you do not use your solar tax credit all within the first year, it gets rolled over into the next tax year.

This is a big benefit to New Mexico residents because many states do not have income taxes, and therefore cannot save this money. Property Tax Exemption for New Mexico Solar Panels
Although New Mexico has some of the lowest property tax rates in the country, an increased home value can still raise your property taxes. In an effort to promote solar energy, the New Mexico property tax code allows homeowners to exempt the appraised property value that arises from a solar energy system. In other words, a solar energy system will increase your home’s value without the burden of an increase in property taxes.
Sales Tax Exemption in NM
As if the property tax exemption wasn’t nice enough, New Mexico also has a sales tax exemption for solar equipment. Considering the sales tax in New Mexico is between 5% to 9% depending on where you live, this can help a lot. If your solar panels were $15,000, for example, you’d avoid having to pay over $700 in sales tax just by living in New Mexico. It will help you save hundreds of dollars or more on your solar panels, which means you can keep more of your savings.
Other incentives for the state of New Mexico depend on where you live and which energy company you’re a customer of. For example, if you are a customer of El Paso Electric Company, you could be eligible for their renewable energy certificate purchase program.
If you’re a customer of El Paso Electric (EPE) or Public Service Company of New Mexico (PNM), you can earn something called Solar Renewable Energy Credits (SRECs). This is a program in which for every kW hour of solar energy your system creates, you can earn cash based on market value.
New Mexico Solar Easements & Solar Rights Laws
New Mexico has a number of Solar Legislation that helps establish your right as a property owner to direct sunlight for your solar energy system, otherwise known as a solar easement.
New Mexico’s Solar Rights Act (1977)
The Solar Rights Act established the right to use solar energy as a property right. The solar right prevents neighboring property owners from obstructing your solar easement with structures or trees. If you have a neighbor who can potentially block your solar panel’s access to sunlight, it would be a good idea to obtain a solar easement.
Solar Recordation Act (1983)
The Solar Recordation Act established the proper procedure for filing a solar right with the county clerk’s office. Once approved, the solar right stays attached to the property even if it is sold. However, the solar right owner does hold the right to sell the solar right separately from the property itself. This allows for a neighboring property owner to purchase the solar right and cancel it if they so chose.
Solar Collector Definitions and Restrictions Bill (2007)
The Solar Collector Definitions Bill strengthened the Solar Rights Act by prohibiting municipality and property owner associations (such as a homeowner’s association) from passing codes and regulations that would deny your right to a solar energy system. The only exceptions being that it is not in installed a historic district and that the request for a home improvement upgrade follows your HOA’s guidelines.

After analyzing 22,000 homes, they found that homes with solar panels fetched a higher asking price than those without. About $4/watt, which comes out to be around $15,000 for residential, depending on your home and solar energy system.
In addition, solar panels can help your property spend less time on the market. In another study done by NREL, they found that solar properties earned about 17% more at closing, in addition to selling 20% faster.
